Terms of Service
Last updated: 18 July 2026
1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of Airfree Maps, including the website at airfreemap.com and any associated mobile applications or APIs (collectively, the “Service”).
The Service is operated by Airfree Geospatial Pty Ltd (ACN to be registered) (“Airfree Geospatial”, “we”, “us”, or “our”), an authorised licensee of Airfree Services Pty Ltd, which owns the Airfree intellectual property and brand.
By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and references to “you” include that organisation.
2. Account Registration
Certain features of the Service require you to create an account. When registering you must:
- Provide accurate, current, and complete information.
- Keep your credentials confidential and not share them with any third party.
- Notify us immediately at support@airfree.au if you suspect unauthorised access to your account.
- Be at least 13 years of age, or the minimum age required by applicable law in your jurisdiction if that is higher.
You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that breach these Terms without prior notice.
3. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree that your use will be:
- Consistent with all applicable local, state, national, and international laws and regulations.
- Respectful of the rights, dignity, and safety of other users and third parties.
- Limited to personal, non-commercial navigation, search, and mapping activities unless you hold a separate commercial licence from us.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for the purposes permitted under these Terms.
4. Prohibited Conduct
You must not, directly or indirectly:
- Scrape or harvest data. Use any automated tool, spider, crawler, bot, script, or other mechanism to systematically extract, copy, index, or collect map data, search results, place information, or any other content from the Service.
- Send automated or bulk queries. Submit queries to the Service at a rate that exceeds normal human interaction or that places unreasonable load on our infrastructure, without our prior written consent.
- Commercially redistribute map data. Re-sell, sublicense, publicly display, or otherwise commercially distribute map tiles, routing results, geocoding responses, or any other data obtained from the Service without a separate written commercial data licence from us.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service.
- Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict use or copying of content.
- Introduce viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
- Impersonate or misrepresent your affiliation with any person or entity, including Airfree Geospatial.
- Use the Service to transmit unsolicited commercial communications or to collect personal information about other users without their consent.
Breach of this section may result in immediate account suspension or termination, and may expose you to civil or criminal liability.
5. Map Data Licence
The base map displayed within the Service is derived from OpenStreetMap data, copyright OpenStreetMap contributors, and is made available under the Open Database Licence (ODbL) v1.0. A copy of the ODbL is available at opendatacommons.org/licenses/odbl.
Additional data layers (cadastre, satellite imagery, elevation, point-of-interest overlays, and real-time feeds) are provided by Airfree Geospatial or its third-party data suppliers under separate licences. Those layers are subject to additional terms disclosed within the Service at the point of access.
You must comply with the attribution and share-alike requirements of the ODbL whenever you reproduce or distribute any map data or derivative works derived from OpenStreetMap content obtained through the Service.
6. User-Generated Content
The Service may allow you to submit content including incident reports, place reviews, photo attachments, comments, and corrections (“User Content”). By submitting User Content you:
- Grant Airfree Geospatial a worldwide, royalty-free, sublicensable, irrevocable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in connection with operating and improving the Service.
- Represent and warrant that you own or have the necessary rights to grant the above licence, and that your User Content does not infringe any third-party intellectual property, privacy, or other rights.
- Acknowledge that incident reports are provided for informational purposes only and must not be relied upon as the sole basis for emergency response or safety-critical decisions.
We reserve the right to remove any User Content at our discretion, without notice, if we believe it violates these Terms or is otherwise harmful.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and disclose information about you, including location data processed when you use navigation or search features.
By using the Service you consent to the collection and use of your information as described in the Privacy Policy.
8. Service Availability and Changes
We provide the Service on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Map data, routing, and search results are provided for convenience only and may not reflect current real-world conditions.
We may, at our sole discretion and at any time:
- Modify, suspend, or discontinue any part of the Service (temporarily or permanently).
- Alter features, pricing, or availability without prior notice.
- Update these Terms, with changes taking effect upon posting the revised Terms on this page.
Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
9. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law, Airfree Geospatial and its affiliates, officers, employees, agents, and licensors expressly disclaim all warranties of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, title, or non-infringement.
In no event shall Airfree Geospatial be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted, or modified.
10. Indemnification
You agree to indemnify, defend, and hold harmless Airfree Geospatial and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your breach of these Terms or your use of the Service, including any User Content you submit.
11. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by Airfree Geospatial. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.
12. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of South Australia, Australia, without regard to its conflict of law provisions.
You agree to submit to the exclusive jurisdiction of the courts of South Australia, Australia to resolve any legal matter arising from these Terms, provided that Airfree Geospatial reserves the right to bring proceedings against you in any other jurisdiction where you reside or carry on business.
13. General
Entire agreement. These Terms, together with the Privacy Policy and any other legal notices or additional terms published by us on the Service, constitute the entire agreement between you and Airfree Geospatial relating to the Service.
Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions, which shall continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
